MOSCOW, Idaho – the man accused of killing four University of Idaho students in 2022, is asking the court to take the death penalty off the table in his pending murder case.
A motion to strike the death penalty from the trial was filed by Kohberger’s defense attorneys on Thursday afternoon. The filing argues that the trial is moving slowly, and that a capital case would take even longer.
Under the reasoning that taking the death penalty out of consideration would hasten the legal process, and that Kohberger has the right to a speed and fair trial, the defense team asked Judge John Judge to strike the prosecution’s notice of intent to seek the death penalty and seat a jury that is not prepared to consider the death penalty.
