BOISE, Idaho – A bill requiring Idaho libraries to restrict content containing LGBTQ+ themes has shifted the policy manuals of institutions across the state.
Despite opposition from the Idaho Library Association, the law went into effect and allows any parent, guardian or child to sue a library for damages if they are found to have circulated “obscene” or “homosexual” media.
Coeur d’Alene Public Library’s website now contains a “Material Review and Relocation Request Form” that allows patrons to offer complaints about material containing homosexuality or sexual content. It references the new book ban and asks for complainants to review the legal language before submitting their issue.
“Please explain how this material meets the definition of Idaho Code § 18-1514 and/or Idaho Code § 18-1517B(2) and should be relocated – see the back of this form for reference,” the form states.
Donnelly Public Library took a slightly different approach, and will now provide a form to parents before their children can check out any books containing three options.
“I will be present with my child at all times at the Donnelly Public Library.”“My child has my permission to be at the Donnelly Public Library without me as the parent for programs, but may not check out any library materials, including books, movies, tablets, etc…” “As the parent or guardian of ____________, I recognize that the Donnelly Public Library contains ‘Adult Material.’ I hereby waive my right(s) to the provisions afforded me through HB710 and allow my child the right to check out materials without my being present.”
The library went on to say that without a parent to initially accompany a child to the library to review the new legal form and make a decision, minors will not be allowed to use the library at all due to legal concerns.
Boise Public Library’s new policy statement regarding the regulations signals the general oppositions of librarians to book censorship.
“The Boise Public Library is very mindful of First Amendment rights to free speech guaranteed to persons in the United States of America, including the right to access information,” the policy states.
Complaints about “obscene” materials containing reference to sexuality or the LGBTQ+ community will be adjudicated by the Boise Library Board according to the new regulations.
The new policies reflect an increasing focus on across the Gem State.
