MOSCOW, Idaho – Prosecutors argued that an official alibi submitted to the court by Bryan Kohberger’s defense team fails to convincingly account for his whereabouts on the night of the quadruple murder for which he is accused.
A Friday court filing submitted by prosecutors fails to meet minimum legally mandated specificity.
“The State respectfully submits that the defendant’s supplemental alibi response continues to lack the specificity required by Idaho Code 19-519,” prosecutors said.
Kohberger’s alibi reaffirmed his initial claim that he was out driving the night of the murders.
“Mr. Kohberger was out driving in the early morning hours…He drove throughout the area south of Pullman, Washington, west of Moscow, Idaho including Wawawai Park,”
The defense team’s alibi went on to claim that cell phone data proves Kohberger was not near the murder scene during the incident. Prosecutors cast aspersions on that claim on Friday.
“This information does not rise to the level of an alibi at the time of the homicides because the Defendant’s cell phone stopped reporting to the cellular network before the homicides and continued to not report until after the homicides,” prosecutors said.
The prosecution’s filing ended with a request for a court order.
“The State respectfully requests that the Court enter an order denying [Kohberger] any further opportunity to add to any purported claim of alibi and preclude testimony by anyone other than the Defendant as to the [his] absence from or presence at the scene of the (homicide),” prosecutors said.
Kohberger’s next hearing, which will address a motion to close the proceedings, is scheduled for May 2.
